Summary

Summary: Evaluates, analyzes, negotiates, and conducts trials on Class C misdemeanor violations arising under the Texas Penal Code, Texas Transportation Code, Health and Safety Code, Education Code and Frisco City Code. Represents interests of the City at hearings in municipal court; negotiates appropriate settlements of municipal court cases; and provides legal advice to City departments within the scope of the foregoing. 

The intent of this position description is to provide a representative summary of the major duties and responsibilities performed by incumbent(s) in this position. Incumbent(s) may not be required to perform all duties in this description and incumbent(s) may be required to perform position-related tasks other than those specifically listed in this description.

Essential Job Functions & Other Important Duties

Essential Job Functions:

  • Prosecutes violations of Class “C” misdemeanors in City municipal court. 
  • In consultation with the City Attorney’s Office, acts as legal resource for City departments in reviewing, providing legal advice on, drafting, and preparing a variety of ordinances and other documents related to class “C” prosecutions. 
  • Pursues civil remedies for enforcement of City ordinances and abatement of public nuisances in municipal court; recommends dismissal or prepares such case for trial; and conducts bench/jury trials. 
  • In consultation with the City Attorney’s Office, conducts research, analysis and writing to draft legal opinions for assigned legal issues or case areas in municipal court; utilizes a variety of resources for research, including computerized legal databases and reference materials; and determines whether information is pertinent and relevant to specific issue or case. 
  • Conducts review of legal documents related to municipal court matters, including public information requests, subpoenas, discovery, contracts, grant agreements, letters, motions, briefs, and correspondence. 
  • Appears in municipal court hearings to represent the City's interests, as required. 
  • Advises City management staff on administrative personnel matters and legal consequences of actions in support of class “C” prosecutions in municipal court; represents the City in such proceedings. 
  • Prepares a variety of legal documents in support of class “C” prosecutions. 
  • Participates in pre-trial preparation of cases set for trial in municipal court; organizes documents; and exhibits used in municipal court cases. 
  • Research legal questions and evaluates the impact on policies and procedures within affected area. Responds to requests from court clerks and police officer for clarification of procedure and interpretation of statutes within affected area. 
  • Coordinates assigned case activities with those of other departments, outside agencies, organizations, and counsel; provides staff assistance to higher level Attorneys; and prepares and presents staff reports and other necessary correspondence. 
  • Reviews legal periodicals to keep abreast of current legal issues and cases; and attends seminars to keep abreast of new laws. 
  • Performs other related duties as required. 
  • Adheres to assigned work schedule as outlined in the Department and City attendance policies and procedures; ensures all behaviors comply with the City’s Personnel Rules and Regulations. 
  • Pursuant to the City of Frisco’s Code of Ordinances and Personnel Rules and Regulations, employees in this position cannot file an appeal of disciplinary actions taken against them. 
 
Other Important Duties:
  • Performs legal research as needed. 
  • Performs such other duties as specified by the City Attorney. 
  • Regular and consistent attendance for the assigned work hours is essential.

  • Knowledge of legal principles, practices, and procedures of civil, criminal, constitutional, and administrative law.

  • Knowledge of the organization, duties, powers, limitations, and authority of City government and the City Attorney’s office.
  • Knowledge of City codes, ordinances, and Charter provisions.

  • Knowledge of federal, state, and local court rules of procedures and evidence.

Education, Experience, and Certifications/Licenses:
  • Juris Doctorate from an accredited law school and two (2) years of court experience in a judicial or prosecutorial capacity in a criminal trial court or equivalent combination of education and experience that support the ability to perform the essential functions and/or skills of the job.
  • Possession of a license from the Supreme Court of Texas to practice law.
  • Must maintain continuing education as required by the State Bar of Texas.   
  • Must pass a pre-employment drug screen, criminal background check and MVR check. 
  • Must possess a valid State of Texas Driver’s License.

  • May be exposed to hostile or angry citizens and criminals.
  • Required to travel to attend required trainings.
